STUDIO ETIQUETTE

Please arrive at least 5 minutes early to class, this allows for a prompt start and for you to settle into the space before your rmovement rituel. If you are new to the studio, we recommend arriving 10 minutes early to your first class so you can be shown through the studio. If you are late, please be mindful of other clients when joining the class. All classes begin with a warm up for your safety. Rituel Movement will not be liable for any injuries that may be sustained during a class as a result of being late and not sufficiently warmed up. Please allow enough time to arrive early and find a park if needed.

Bring a water bottle and small towel, especially for strength classes. Grip socks are mandatory for all Rituel Movement classes. If you forget yours, you can purchase a pair in the studio for $25.

If you have any injuries or are pre/post natal, please inform your instructor before the class begins so they can provide you with the necessary modifications.

As a courtesy to others, please keep your mobile phone switched off or on silent and stored in the locker area during the class. Please only attend to your phone after the class has finished. Smart watches must be turned to silent mode.

And finally, we understand that life can happen and plans can change, but as our classes are limited in size, if you are no longer able to attend, please late cancel with as much notice as possible so that someone on the waitlist may attend instead. Please see below for more details on our cancellation and no-show policy.

CANCELLATION POLICY

Class sizes are limited and so we recommend that you pre-book via the website or through the Momence app. Bookings open 14 days in advance. Due to the high demand of classes, if you are unable to attend, please ensure you cancel in advance so that another client may be able to join the class. In order to cancel without penalty you must do this through your profile on the Momence app. Please note the cancellation window is 12 hours prior to class commencing. Any cancellations within that time period will incur a fee.

  • For members this will be a $15 fee charged to the credit card on file.

  • For class pack & casual class holders you will forfeit one class credit. This includes no shows (no cancellation and no attendance).

  • For any membership no shows (no cancellation) a fee of $20 will be charged to the credit card on file.

Please note there are no exceptions to this policy. We appreciate your understanding and cooperation.

Memberships

You are able to sign up for memberships with Rituel Movement via the link in the website or via your Momence profile. The minimum commitment is three months for all memberships, except for The Flexible Rituel, which is month to month. Your membership can be paused at any time for up to 28 days within one calendar year. Any requests to pause your membership, please email hello@rituelmovement.com with the specific details of the pause, at least 14 days prior to your next billing date.

If you wish to cancel your membership, the same process applies. Please email us with at least 14 days notice before your next payment is due. Please note memberships are paid in advance, so no refunds can be provided for late notice. You will however have full access to our services until the cancellation date. You will be notified of your cancelled membership once it’s been fully processed.

CLASS PACKS

Class packs for group classes and studio experience sessions are available to purchase via the website or your profile in the Momence app.

Class packs do have an expiration date:

  • 5 packs - use within 2 months

  • 10 packs - use within 3 months

  • 20 packs - use within 6 months

Returns & Refunds

All purchases and direct debit transactions are non-negotiable, non transferable and non-refundable. Unfortunately we are unable to refund a member or pack holder for any unused classes or membership periods. However, you will retain full access to the classes until the cancellation date.

Offers

Welcome Packs (and any other intro offers that are promoted from time to time) are only available to new clients of Rituel Movement and you can only purchase it once. The offer is non-refundable and non-transferable and will activate from your first class booking. The RItuel Movement Welcome Pass includes movement assessment, goal setting and reviews with a Rituel Movement instructor. The group classes can be used across all reformer and mat classes including Baby & Me, Barre and Strength. During your one on one session, you will have the opportunity to collaborate on your group class pathway. Once the 28 days have passed, you will need to purchase a membership, pack or casual class in order to continue booking classes.

WEBSITE TERMS OF USE

This website (Site) is operated by Rituel Studios Pty Ltd T/A Rituel Movement (ABN 82 693 841 744) (we, our or us). These website terms of use (Terms) apply to your use of, and access to, the Site.

Information and availability

While we use reasonable attempts to ensure the accuracy and completeness of the content and materials on the Site (Content), to the extent permitted by law (including the Australian Consumer Law), we do not warrant the accuracy, completeness or suitability of any of the Content. The Content may be subject to change without notice and we do not undertake to keep the Site up-to-date. The Content is factual information only, is not comprehensive and is for general information purposes only. We also do not warrant that access to the Site will be uninterrupted, error-free or free from viruses.

Intellectual Property rights

Unless otherwise indicated, we own or license the Content and all intellectual property rights (including any copyright, registered or unregistered designs, illustrations, artwork, patents or trade mark or logo rights and domain names) displayed or used on the Site (Our Intellectual Property).

We authorise you to access and use the Site solely for your own personal use and to display, print and download the Content onto your personal device provided that you do not remove any copyright notice included in Our Intellectual Property.

Subject to the above, your use of, and access to, the Site and the Content does not grant or transfer to you any rights, title or interest to Our Intellectual Property. Unless otherwise permitted in these Terms, you must not:

  • copy or use, in whole or in part, any of Our Intellectual Property;

  • reproduce, retransmit, distribute, display, disseminate, sell, publish, broadcast or circulate any of Our Intellectual Property; or

  • breach any intellectual property rights connected with Our Intellectual Property, including altering or modifying any of Our Intellectual Property, causing any of Our Intellectual Property to be framed or embedded in another website or platform, or creating derivative works from Our Intellectual Property.

Nothing in the above clause restricts your ability to publish, post or repost Content or Our Intellectual Property on your social media page or blog, provided that:

  • you do not assert that you are the owner of the Content or Our Intellectual Property;

  • unless explicitly agreed by us in writing, you do not assert that you are endorsed or approved by us;

  • you do not damage or take advantage of our reputation, including in a manner that is illegal, unfair, misleading or deceptive; and

  • you comply with all other terms of these Terms.

Conduct we don’t accept

You must not do or attempt to do anything that is unlawful, which is prohibited by applicable law, which we would consider inappropriate or which might bring us or the Site into disrepute. This includes:

  • anything that would constitute a breach of an individual’s privacy (including uploading private or personal information without an individual's consent) or any other legal rights;

  • using the Site to defame, harass, threaten, menace or offend any person;

  • using the Site for unlawful purposes;

  • interfering with any user of the Site;

  • tampering with or modifying the Site, knowingly transmitting viruses or other disabling features, or damaging or interfering with the Site, including using trojan horses, viruses or piracy or programming routines that may damage or interfere with the Site;

  • using the Site to send unsolicited electronic messages;

  • using data mining, robots, screen scraping or similar data gathering and extraction tools on the Site; or

  • facilitating or assisting a third party to do any of the above acts.

Third party sites

The Site may contain links to websites operated by third parties. Unless we tell you otherwise, we do not control, endorse or approve, and are not responsible for, the content on those websites. We recommend that you make your own investigations with respect to the suitability of those websites. If you purchase goods or services from a third party website linked from the Site, such third party provides the goods and services to you, not us.

Our liability is limited

You may have certain rights under the Australian Consumer Law in relation to the Site and the Content, and you may contact us for more information about this. Despite anything to the contrary, to the maximum extent permitted by law (including the Australian Consumer Law), we exclude all liability for any loss or damage of any kind (including consequential loss, indirect loss, loss of profit, loss of benefit, loss of opportunity or loss of reputation) whether under statute, contract, equity, tort (including negligence), indemnity or otherwise arising out of or in connection with the Site or the Content.

Privacy

We respect your privacy and understand protecting your personal information is important. Our Privacy Policy (available on the Site) sets out how we will collect and handle your personal information.

What happens if we discontinue the Site

We may, at any time and without notice, discontinue the Site (in whole or in part), or exclude any person from using our Site.

Which laws govern these Terms

These Terms are governed by the laws of New South Wales.  Each party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in New South Wales and any courts entitled to hear appeals from those courts and waives any right to object to proceedings being brought in those courts. 

Changes to these Terms

We may, at any time and at our discretion, vary these Terms by publishing the varied terms on the Site. We recommend you check the Site regularly to ensure you are aware of our current terms.

LIABILITY WAIVER

In consideration of Rituel Studios Pty Ltd (ACN 693 841 744) T/A Rituel Movement (we, us or our) providing the Activities (as defined below), this Waiver of Liability (Waiver) is made with Rituel Movement by the individual undertaking the Activities (Participant, you or your), or where the Participant is under 18 years old, the Participant’s legal guardian.

Acceptance

By signing this Waiver, you agree that you have read, accepted and will comply with this Waiver, and that you are 18 years or older. If you are accepting this Waiver as a parent or legal guardian of the Participant, you warrant and agree that you have the required authority to consent on behalf of the Participant.

You agree that this Waiver is governed by the laws of New South Wales and you submit to the exclusive jurisdiction of the courts of New South Wales.

Risk

The Participant will be participating in Pilates (including reformer Pilates), fitness and exercise activities and other related activities (Activities). Participating in the Activities may expose the Participant to the risk of death, physical harm, personal injury, psychological and emotional harm, physical exertion, disease, illness and/or loss or damage to property which may arise from:

• third party participants;

• the Participant’s physical fitness level, tiredness or overexertion;

• strenuous exercises;

• the Participant’s training technique;

• pre-existing health conditions;

• equipment supplied by us to carry out the Activities; or

• any failure to comply with our instructions or directions.

You have read this risk warning and you are aware of and voluntarily accept any risk that may arise from the Participant’s participation in the Activities.

Medical Conditions

In the event that you become aware of any medical, physical or psychological condition, injury or impairment that may be detrimental to the Participant’s health, a risk to the Participant’s safety or affect the Participant’s proper and safe participation in the Activities, the Participant must stop participating and you should contact a medical provider. You agree to notify us of any pre-existing conditions, including medications, that may affect the Participant prior to participating in the Activities and to immediately notify us of any injuries that occur while participating in the Activities.

You warrant to us that:

• the Participant has the required physical health and fitness needed to participate in the Activities; and

• you know of no medical or other reason why the Participant cannot or should not participate in the Activities.

You acknowledge that our instructors hold Pilates qualifications and operate within their scope of practice. If an instructor observes something that may require medical attention, they may recommend that you consult with an allied health professional for assessment. You remain solely responsible for your own health and fitness to participate in the Activities.

Exclusion of Liability

Under the Australian Consumer Law (Cth) (ACL), statutory guarantees apply to the supply of services. As the Activities are recreational services, under the ACL, we may ask you to agree to exclude your rights in relation to these statutory guarantees.

To the maximum extent permitted by law, we will not be liable for, and you waive and release us from and against any loss or liability arising from or in connection with any personal injury or death caused or contributed to by the Participant’s participation in the Activities, except where caused by our reckless conduct.
